Allocation of Responsibility

1. Obligations of the Transporting Party

  • Ensure safe transportation: The transporting party must ensure the property is transported to the agreed destination, on time, and in a safe and complete condition.
  • Deliver property to the rightful recipient: The transporting party is responsible for delivering the property to the designated person or the person entitled to receive it according to regulations.
  • Bear transportation costs, unless otherwise agreed: The transporting party shall bear the transportation costs, unless otherwise agreed upon by the parties.
  • Purchase civil liability insurance as required by law: The transporting party shall purchase civil liability insurance in accordance with the law.
  • Compensate for damages: In case the property is lost or damaged due to the fault of the transporting party, the transporting party must compensate the hiring party for the damages, unless otherwise agreed or stipulated by law.

2. Rights of the Transporting Party

  • Verify authenticity: The transporting party has the right to verify the authenticity of the property, waybill, or other shipping documents.
  • Refuse transportation: If the property does not match the type agreed upon in the contract, the transporting party has the right to refuse transportation.
  • Demand payment of freight charges: The transporting party has the right to demand full payment of freight charges from the hiring party according to the agreed terms and schedule.
  • Refuse to transport prohibited goods: The transporting party has the right to refuse to transport goods that are prohibited from trading or are dangerous or toxic without safety measures.

3. Obligations of the Hiring Party

  • Pay freight charges: The hiring party is obligated to pay the full freight charges to the transporting party according to the agreed terms and payment method.
  • Provide relevant information: The hiring party must provide necessary information related to the property to ensure safety during transportation.
  • Supervise property: If agreed, the hiring party may supervise the property during transportation. However, in case the property is lost or damaged while under the supervision of the hiring party, the hiring party will not be compensated.

4. Rights of the Hiring Party

  • Demand timely transportation: The hiring party has the right to demand that the transporting party deliver the property to the agreed destination at the agreed time.
  • Receive the transported property: The hiring party has the right to directly or designate a third party to receive the transported property.

5. Liability for Damages

  • Liability of the transporting party: If the property is lost or damaged due to the fault of the transporting party, the transporting party must compensate the hiring party for the damages.
  • Liability of the hiring party: If the property is dangerous or toxic and is not properly packaged or secured, leading to damage to the transporting party or a third party, the hiring party must be liable for compensation.
  • Force majeure: If the property is lost, damaged, or destroyed due to force majeure events such as natural disasters or traffic accidents, the transporting party will not be liable for compensation, unless otherwise agreed or stipulated by law.
